What Classifies As A Personal Injury?

As a general rule there are two types of personal injuries:

1. Physical Injury – this will include illness, personal injury, and disease. This type of injury can be a result of several factors, such as a traffic accident, workplace injury, an injury sustained by tripping or falling, or an injury caused by using goods or services that are found to be faulty.

2. Psychological Injury – which causes undue stress due to discrimination in the workplace, or even as a victim of a crime.

Both types of injuries can also result in receiving a wrong treatment in a hospital.

If a personal injury is incurred due to a traffic accident, the police record any injury caused by that event. If an injury occurs in the workplace, the employer must record the details of the accident in an appropriate log. Should an injury incur due to use of a faulty device, it is necessary to inform the store from where the device was purchased.

You also need to inform your insurance company of the injury you have sustained.

Informing your doctor of the personal injury is necessary because if the injury is not treated appropriately, it may lead to further complications later on.

Be sure to gather all of the evidence related to the injury, including any witness accounts. Presenting a complete evidence record will assist you in making your claim for compensation.

It’s advisable to keep this record even if you do not file a claim. Future complications may arise due to the injury, and memory of the events won’t always be as accurate as well-documented records.

Another thing to keep in mind is personal injury doesn’t necessarily have to be claimed by the victim. A relative or spouse of the victim can file the claim on their behalf. If the victim suffers permanent disability or even dies due to an injury, the spouse and/or children may claim compensation.
